TripCircle Terms of Service

The following terms of service (the "Terms") govern the use of the TripCircle trip-planning platform (the "Service"), including but not limited to through our web site, mobile app, call center or email support.

These Terms are an enforceable contract between you, the user of the Service, and:

All provisions of these Terms are severable. If any provision of these Terms is held invalid or unenforceable, all other provisions remain in effect.

We may revise these Terms from time to time. Your continued use of the Service after the effective date of the new Terms constitutes your acceptance of the changes. If you do not accept the updated Terms, you must stop using the service and contact us to close your account.

1. The Service

What We Provide

TripCircle is a collaborative group travel planning tool. We help you organize trips, itineraries, and group decisions.

TripCircle is not a travel agency or booking provider. When you use links to reserve flights, hotels, rentals, or experiences, you transact directly with the third-party partner. TripCircle Inc. has zero liability for those bookings or any issues arising from them.

We reserve the right to modify or discontinue the Service at any time, with or without notice. We may add or remove features and functionality, or restrict access from certain markets or jurisdictions, and functionality may be different based on how you access the Service, for example, between our website and mobile app.

The Service is currently available in Beta. Certain functionality may be incomplete or unavailable at any time, and may produce incorrect results. You understand and accept these risks by using the Service.

We reserve the right to suspend or remove your ability to access the Service at any time for any reason and without notice.

2. Authorized Use

We make the Service available for personal, noncommercial use only.

The Service is not intended for users under the age of 18. Users under 18 are prohibited from using the Service, and users are expressly prohibited from submitting personal information relating to individuals under the age of 16 to the Service, and we will not knowingly use, retain or disclose such information.

You agree not to access the Service through any automated means not provided or authorized by us, including but not limited to scripts, bots, or screen-scraping. You agree not to attempt to exploit, reproduce, resell or reverse-engineer the Service or defeat security controls.

You agree not to use the Service for any purpose or in any manner that would violate applicable law or these Terms. You agree not to use the Service to store or disseminate any content that is prohibited by applicable law, infringes the rights of others, or, in our sole discretion, is harmful, harassing, threatening, obscene, defamatory, fraudulent, hateful, or otherwise objectionable. You also agree not to use the Service to disseminate unauthorized advertising or solicitations.

3. Intellectual Property

TripCircle's code, design, branding, and materials belong to TripCircle Inc. You may not copy, modify, reproduce, or distribute any part of the Service without express written permission from us.

4. User Generated Content

You are responsible for any content that you upload to the Service, including but not limited to reviews, photos, and messages. By posting content to the Service, you grant, and represent and warrant that you have the right to grant, to us an irrevocable, perpetual, non-exclusive, transferable, worldwide license (with right to sublicense) to make copies, prepare derivative works of, distribute copies, and publicly perform or display such content for any purpose, commercial, advertising, or otherwise in connection with the Service. We may, but are not obligated to, delete or remove without notice any content that in our sole discretion violates these Terms. The Service is not intended to be used as the sole storage location for your content, and we are not responsible for loss of any content that you upload to the Service.

You retain ownership of any content that you upload to the Service. We will not use your content to train AI models.

5. Copyright Complaints

If you believe that material on the Service infringes upon a copyright that you own or control, in accordance with the Digital Millennium Copyright Act, you may send a written notification of such infringement to our designated DMCA agent:

TripCircle Inc. has also registered this designated agent with the U.S. Copyright Office as required by the DMCA.

Feedback

If you provide us with suggestions, feature requests, bug reports, reviews, or testimonials ("Feedback"), you agree that such Feedback becomes our exclusive property, and we shall have the right to use and share such Feedback without attribution to you, compensation, or your consent.

6. Third-Party Services

Links to external booking sites or tools are provided for convenience. TripCircle Inc. does not control or guarantee those services. Any issues with bookings or payments must be handled with the external provider.

Third-Party Bookings and No Liability

TripCircle is a trip-planning tool, not a travel agency or service provider. When you book flights, hotels, rentals, or experiences through links on TripCircle, you are completing your reservation directly with an independent third-party provider. They control the inventory, pricing, policies, and fulfillment of your booking.

Separate Agreement with the Provider

Every booking is a separate contract between you and the third-party provider. They are responsible for honoring the reservation, managing availability, handling payments, and resolving any issues that arise. TripCircle Inc. assumes no liability for the accuracy of information provided by our third-party providers or damages caused by the acts or omissions of such third-party providers, including but not limited to delay, cancellation, overbooking, pricing changes, personal injury or death, or property loss or damage.

TripCircle's Role

We aim to make trip planning easier and more organized, but we do not manage, operate, or control any part of the actual travel services you book. Because of this, we cannot guarantee availability, accuracy, delivery, quality, or outcomes of those services.

How TripCircle Supports You

If something goes wrong with a booking, we will always try to help. We want users to have smooth experiences, and we understand how stressful travel disruptions can be. TripCircle Inc. will make reasonable efforts to help communicate with the provider, clarify details about the issue, provide guidance on next steps, and point you to the provider’s official support or claims channels. We step in because we care about your experience, not because we control the outcome.

What TripCircle Cannot Do

Because we do not operate or sell the service, we cannot issue refunds, modify or cancel bookings, guarantee provider decisions, force a provider to offer compensation, or take financial responsibility for their mistakes. TripCircle Inc. does not have authority over third-party systems or policies.

Final Responsibility

The third-party provider is ultimately responsible for resolving booking-related issues and determining any refunds, credits, compensation, or accommodations. TripCircle Inc. supports you where possible, but legal and operational responsibility stays with the provider.

7. Account Security

You are responsible for safeguarding your login credentials and notifying us of any unauthorized access.

8. Limitation of Liability

We provide the service as-is to the maximum extent permitted by law. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

To the maximum extent permitted by applicable law, TripCircle Inc., our affiliates, and our service providers shall not be liable to you or any third parties for any incidental or consequential damages related to the Service, including any reliance on information provided through the Service, even if advised of the possibility of such damages.

Some jurisdictions do not allow disclaimers of implied warranties or the limitation of liability for incidental or consequential damages, in which case some of the disclaimers or limitations above may not apply to your use of the Service.

9. Governing Law and Choice of Forum

These Terms, including any disputes in court or arbitration, are governed by the laws of the State of Delaware, without regard to conflicts of law provisions. Subject to the mandatory arbitration provision herein, any judicial proceeding to resolve claims relating to these Terms shall be brought in the federal or state courts of Cook County, Illinois, and you consent to venue and personal jurisdiction of the courts located in Cook County, Illinois.

10. Mandatory Arbitration

If you are a user in the United States, any controversy or claim arising out of or relating to these Terms, or the breach thereof, except for intellectual property rights or matters that you may bring in small claims court, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. You agree that this arbitration agreement extends to the determination of the scope or applicability of the agreement to arbitrate, and that the interpretation and enforcement of this provision shall be governed by the Federal Arbitration Act.
